CRA Voluntary Disclosure Program (VDP): How to Fix Past Tax Mistakes

The Canada Revenue Agency's Voluntary Disclosure Program (VDP) allows individuals and businesses to come forward and correct past tax mistakes — missing returns, unreported income, incorrect deductions — before the CRA discovers the problem. Coming forward voluntarily typically reduces or eliminates the penalties you'd face if the CRA found the issue first.

Who the VDP Is For

The VDP is designed for taxpayers who:

  • Failed to file one or more tax returns (T1, T2, GST/HST, T4, etc.)
  • Did not report income (domestic or foreign)
  • Overclaimed deductions or credits
  • Made errors in a previously filed return
  • Didn't remit source deductions (payroll taxes) on time

Critical: The Voluntary Requirement

To qualify for the VDP, the disclosure must be truly voluntary. This means:

  • The CRA has not already contacted you about the issue
  • You are not already under audit or investigation for the matter
  • You are not responding to a CRA enforcement action or court proceedings

If the CRA sent you even a general audit letter before you submitted your VDP application, you may be disqualified from the program.

Two VDP Tracks

Since 2018, the CRA operates two VDP tracks depending on the nature of the non-compliance:

General Program

For most tax mistakes — missed income, unfiled returns, incorrect credits. Benefits include full penalty relief and partial interest relief (usually 50% of the accumulated interest).

Limited Program

For deliberate non-compliance — situations where the CRA determines you intentionally hid income or participated in aggressive tax avoidance. Benefits are more limited: no penalty relief, and only 50% interest relief for the past 3 years.

The CRA decides which track applies based on facts — you don't choose. Factors pointing to the Limited Program include: large dollar amounts, sophisticated arrangements, offshore accounts, or a pattern of non-compliance.

What You Must Provide

A complete VDP application requires:

  • A cover letter explaining the circumstances and reasons for the non-compliance
  • All unfiled returns for the years in question (fully completed)
  • Supporting documentation (T4s, T5s, foreign income statements, receipts)
  • Payment of all taxes owing (or a payment arrangement)

The CRA does not grant VDP protection on incomplete applications. If you submit a VDP and the return isn't complete, you lose the protection for that period.

How Far Back Does the VDP Go?

Generally, the VDP covers the past 10 calendar years for most returns. For unfiled T4 and payroll returns, it's typically 4 years. The CRA has discretion to go further back in some cases but rarely does.

After the VDP Is Accepted

Once the CRA accepts your VDP application, they will issue a Notice of Assessment for each year covered. You will owe the tax plus interest (at the prescribed rate, compounded daily), minus any interest relief granted. Penalties will be waived or reduced depending on which track applies.

Protecting Yourself Going Forward

The VDP clears past liabilities — it doesn't prevent future problems. After using the VDP, establish proper systems: monthly bookkeeping, quarterly GST/HST remittances, annual T4 filings, and current T2 filings. A second VDP application is possible but viewed negatively by the CRA.
